Terms and Conditions
1. Purpose and Scope
These Terms and Conditions of Use (“Terms”) govern access to and use of the websites, portals, and digital applications of [Company] (“Platforms”) operated by the Company, as well as its partners and affiliated companies (hereinafter collectively referred to as the “Company”), including, without limitation and subject to change, the following entities:
- ManpowerGroup Portugal SGPS, S.A.;
- Manpower Portugal Empresa de Trabalho Temporário, S.A.;
- Manpower Talent Based Outsourcing Unipessoal, Lda.;
- Experis Sociedade Unipessoal, Lda.;
- ManpowerGroup Global Business Service, Unipessoal, Lda.,
all headquartered at Rua Tomás da Fonseca, Torre G, 15th Floor, 1600, 1200-209 Lisbon.
The Company provides, among others, the following services:
Services for Companies:
- Recruitment and selection of permanent, temporary, and specialized personnel;
- Administrative and contractual management of temporary workers;
- Outsourcing and human resources consulting services;
- Digital solutions for workforce and process management (RPO, MSP, etc.).
Clients may access digital portals for managing candidates, temporary workers, and administrative processes.
Certain services are provided in partnership with third parties and are also governed by those partners’ terms and policies.
Services for Candidates and Workers:
- Online registration and application management;
- Access to job offers and CV submission;
- Monitoring of recruitment processes and contract management.
Candidates may submit applications:
- With or without creating a personal account (“Personal Area”);
- Spontaneously or in response to a specific job offer;
- By uploading documents or importing profiles from social networks.
Creating a personal account implies acceptance of the Terms and inclusion in the Company’s candidate database.
Complementary Digital Services:
- Time and activity management;
- Client and candidate portals;
- Mobile applications and professional newsletters.
The processing of personal data is governed by separate documents: the Privacy Policy and the Cookie Policy, available in the footer of the Platforms.
By using the Platforms, the User accepts these Terms. If you do not agree, you should not use them.
2. Definitions
- Company: the group of companies established in Portugal identified above.
- User: any individual or legal entity accessing or using the Platforms.
- Candidate: an individual using job-related features (e.g., job search, application submission).
- Client: an individual or legal entity with access to B2B features.
- Account: registration that allows access to restricted areas.
- Content: texts, images, trademarks, logos, software, databases, and other materials available on the Platforms.
- Spontaneous Application: a voluntary expression of interest not linked to a specific job offer, where the candidate sends their CV and/or professional information to the Company for internal analysis for future opportunities.
- Application to a Job Offer: an expression of interest in a specific job offer, identified by reference, title, or code, where the candidate submits their CV and/or additional information exclusively for that offer.
- Candidate Database: if a candidate is not selected, the Company may retain their CV and professional data for future opportunities. The candidate may object or request deletion at any time via the channels in the Privacy Policy.
- Personal Data: any information relating to an identified or identifiable individual, as defined by the GDPR.
3. Access and Eligibility
- Access is permitted to individuals aged 18 or older; minors only with parental consent where legally allowed.
- Legal entities act through authorized representatives.
- Access to restricted areas may require account creation with truthful, complete, and updated information.
4. Account and Credentials
- Users must keep their credentials confidential and are responsible for activities performed under their account.
- In case of unauthorized access or loss of control, the User must immediately notify the Company.
5. Proper Use and Technical Integrity
- It is prohibited to upload illegal, offensive, defamatory, or discriminatory content.
- It is forbidden to introduce malware, perform abusive scraping, reverse engineering, or bypass technical protection measures.
- Violating intellectual property, confidentiality, privacy, or trade secrets is not allowed.
- The Company may apply immediate technical measures to protect stability and security (e.g., request or traffic limitations).
6. Features for Candidates and Clients
- Candidates can browse job offers, submit applications, and track their process.
- Clients can access B2B portals to manage requests, workers, and processes.
- Creating an account does not imply inclusion in the candidate database without proper consent as described in the Privacy Policy.
7. Third-Party Services and Integrations
- Some features rely on third parties (e.g., ATS systems, hosting, communications) and may be subject to their terms.
- The Company selects such third parties diligently but cannot guarantee uninterrupted availability.
8. User Content
- Users retain ownership of uploaded content.
- Users grant the Company a non-exclusive, limited, and revocable license to operate requested features (e.g., storing a CV for a submitted application).
- Users guarantee they have rights to upload content and will indemnify the Company for third-party claims resulting from unlawful use.
- The Company may remove clearly illegal or non-compliant content and will inform the User briefly.
9. Intellectual Property
- Platform content belongs to the Company or licensed third parties and is protected by law.
- Reproduction, modification, distribution, publication, or exploitation of content is prohibited without written authorization, except for normal use of the Platforms.
- Use of the Company’s trademarks and distinctive signs is prohibited without prior written consent.
10. Availability, Maintenance, and Security
- The Company makes reasonable efforts to ensure availability and security, including scheduled maintenance or urgent interventions.
- No guarantee is given against interruptions, errors, vulnerabilities, or data loss not caused by willful misconduct or gross negligence.
11. Privacy and Cookies
- Personal data processing is governed by the Privacy Policy, which outlines purposes, legal bases, retention periods, recipients, and rights.
- The use of cookies and similar technologies is governed by the Cookie Policy and consent manager, allowing users to accept, reject, or customize preferences.
12. Changes to the Terms
- The Company may change these Terms; the current version is published on the Platforms with a date.
- Material changes affecting rights or obligations will be communicated in advance and may require renewed acceptance for access to restricted areas.
13. Suspension and Termination
- The Company may suspend or terminate an account or access to the Platforms in cases of: material breach of these Terms; security or technical integrity risks; legal orders; or service termination.
- Where reasonably possible, prior notice will be given with a brief explanation and effective date.
- Suspension or termination does not affect accrued rights or obligations.
- Data and file handling follow the Privacy Policy and applicable law (retention and deletion periods).
14. Governing Law and Jurisdiction
- These Terms are governed by Portuguese law, and the Judicial Court of the District of Lisbon shall have jurisdiction, without prejudice to mandatory legal provisions.
